THIS IS A BINDING CONTRACT. PLEASE REVIEW IT CAREFULLY. THE CUSTOMER IS RESPONSIBLE FOR ENSURING THAT HE OR SHE COMPLIES WITH THESE TERMS AND CONDITIONS, AS THEY MAY BE AMENDED FROM TIME TO TIME. FAILURE TO COMPLY WITH THESE TERMS AND CONDITIONS GIVES GUARDIAN THE RIGHT TO IMMEDIATELY, WITHOUT PRIOR NOTICE, TERMINATE THE CUSTOMER'S PARTICIPATION IN GUARDIAN'S EZPAY PROGRAM.

THE CUSTOMER ACKNOWLEDGES THAT, BY ENROLLING IN GUARDIAN'S EZPAY PROGRAM, BY PAYING A PERIODIC BILLING STATEMENT FOR HIS OR HER GUARDIAN ACCOUNT THROUGH GUARDIAN'S EZPAY PROGRAM, AND/OR BY HIS OR HER CONTINUED ENROLLMENT IN, AND/OR PAYMENT OF HIS OR HER MONTHLY BILLING STATEMENT THROUGH, GUARDIAN'S EZPAY PROGRAM, THE CUSTOMER IS DEEMED TO HAVE AGREED TO AND ACCEPTED THE TERMS AND CONDITIONS CONTAINED HEREIN, AS THEY MAY BE AMENDED FROM TIME TO TIME. IF THE CUSTOMER DOES NOT AGREE TO ANY OF THESE TERMS AND CONDITIONS, THE CUSTOMER MUST NOT USE THE EZPAY PROGRAM, OR MUST CEASE USING THE EZPAY PROGRAM, AND CONTACT GUARDIAN IMMEDIATELY.

I, the customer (''I'' or ''my''), authorize Guardian Protection Services, Inc. (''Guardian'') to enroll me in Guardian's recurring electronic billing program, (the ''EZPay Program''). I have completed the EZPay Program enrollment form, as such form may be amended from time to time, or otherwise enrolled in the EZPay Program.

I authorize Guardian to initiate scheduled, recurring charges to my credit card or electronic funds transfers from my checking or savings account for the recurring, monthly fees for the monitoring and/or service program(s) to which I subscribe, (the ''Recurring Charge(s)'') on the Guardian account for which I have requested electronic billing, (my ''Guardian Account''). I understand Guardian will initiate Recurring Charges for the amount due on my Guardian Account at the time the Recurring Charge is initiated. I further understand that non-recurring amounts, such as fees for service calls or guard response service, are not part of the Recurring Charges and will be billed to me separately. Notwithstanding the foregoing, I understand that I have the option of permitting Guardian to collect my installation fee as a one-time charge through EZPay. If I agreed to exercise that option, I indicated that choice on my EZPay enrollment form.

I understand that I will no longer receive a paper monthly billing statement in the mail for the Recurring Charges, however, I will receive a paper billing statement in the mail for fees or charges that are not Recurring Charges. I further understand that I may contact Guardian's billing department at 1-800-250-6426 at any time if I have questions about my bill.

The scheduled payment date for each Recurring Charge will be the same scheduled payment date that was applicable to my paper billing statement, (i.e., if my paper billing statements were due on the 15th of each month, my Recurring Charge will be due on the 15th of each month), except when such payment due date falls on a day that is not a business day at the financial institution that maintains my credit card or checking or savings account, in which event the scheduled payment date will be the next business day after the regular payment due date. (E.g., if the due date falls on a Sunday, and my relevant financial institution is closed on Sundays, then the scheduled payment due date will be the following Monday). Neither enrolling in the EZPay Program, nor withdrawing from the EZPay Program, will change the billing cycle or due date of my Guardian bill.

I understand that my participation in the EZPay Program is entirely optional and is not required to obtain or maintain my Guardian Account.

I understand that I may disenroll from the EZPay Program at any time by calling Guardian's customer service center at 1-888-895-4805. I understand that Guardian will not initiate further Recurring Charges after Guardian (i) has received my disenrollment request and (ii) has had a reasonable period of time in which to act upon such request. This right to disenroll is in addition to my right to stop payment by directly contacting my financial institution where I maintain my credit card or checking or savings account. I understand that, upon my disenrollment, (i) if I received a discount on any of my Recurring Charges because of my enrollment in EZPay, such discounts will be discontinued, (ii) if I participate in any additional programs related to my participation in EZPay, I will be automatically disenrolled from such programs, and (iii) Guardian will resume mailing paper billing statements to the billing address on file for my Guardian Account.

If a Recurring Charge cannot be made because of insufficient funds (or for any other reason permitted by applicable law, as indicated on my sales and monitoring agreement), a returned debit item fee of twenty dollars ($20.00) (or such other amount as may be indicated on my sales and monitoring agreement) will be charged to my Guardian Account. I understand that, if a Recurring Charge cannot be made for any given payment, Guardian will automatically cancel my participation in the EZPay Program, at which time Guardian will notify me of the cancellation of my participation.

By agreeing to the terms and conditions, I acknowledge I understand and authorize all of the above.

I understand that I must agree to, and continue to abide by, the terms and conditions set forth herein in order to participate in, and use, the EZPay Program. By enrolling in and/or using the EZPay Program, I represent that I am of legal age, I am duly authorized to enroll in and use the EZPay Program, and I am duly authorized to agree to, and become bound by, these terms and conditions. I understand that, if I do not agree, and/or cannot comply, with any or all of these terms and conditions, I must immediately stop use of the EZPay Program and notify Guardian so that I can be disenrolled from the EZPay Program.

I understand that Guardian reserves the right to amend, modify, supplement, or replace any or all of the terms and conditions at any time and for any reason with or without advance notice of any kind by posting any amendments, modifications, supplements or replacements to the Guardian website at guardianprotection.com (the ''Website'') or providing such amendments, modifications, supplements or replacements to me via hard or soft copy, as determined by Guardian in its sole and absolute discretion. As such, I understand that it is incumbent upon me to check the Website from time to time for any amendments or other updates. I acknowledge that my continued use of the EZPay Program after any amendments are posted to the Website, or are provided to me via hard or soft copy, as ultimately determined by Guardian, will constitute my acceptance of such amendment.
